Aircraft Rental and Use Agreement

For the safety and convenience of our customers, the following policies, terms, and conditions have been created for all students, renters, and instructors (Pilots) operating Wright Flyers Aviation, Inc. (WFA) aircraft:

1. Every Pilot is required to follow all regulations and meet currency requirements as set forth by the Federal Aviation Administration (FAA), Transportation Security Agency (TSA) and WFA policies.

2. Pilots must have the following on file, or in place at WFA prior to reserving an aircraft:

  1. Flight Training Registration Form or Rental Pilot Information Sheet.
  2. Record of a current FAA Medical Certificate and Pilot's Certificate with Flight Review endorsement.
  3. Record of aircraft checkout with currency information completed and signed by a WFA instructor.
  4. Either a 1) Credit Card Authorization Form [MasterCard, Visa or Discover/Novus issued by a U.S. financial institution], or 2) $2,000 refundable cash deposit.
  5. Signed form affirming that FAA mandated security training has been completed.

3. WFA will rent aircraft in airworthy condition, and will inform the pilot of any problem WFA is aware of at the time of rental. WFA is not liable for, and does not guarantee that a pilot will be meet their personal schedule, business schedule, or the intended purpose of the flight based on the performance of WFA aircraft.

4. Any problems with WFA aircraft should be reported immediately to the WFA Dispatcher and recorded on the aircraft's problem log-sheet. The pilot should review the problem log-sheet before each flight to ensure that all write-ups have been placarded, corrected, or signed-off.

5. All pilots are responsible for reporting any damage to WFA aircraft before the flight. The pilot will be liable for any unreported damage, such as flat spots on tires or damaged wing tips.

6. Pilots are solely responsible for following the proper fueling procedures for the aircraft they are flying. Pilots must always use an approved Gasoline Analysis Separator (GATS) jar when sampling fuel from a Wright Flyers aircraft. The GATS jar allows the pilot to return uncontaminated fuel samples to the aircraft fuel tank. Samples suspected of contamination should be taken immediately to an A&P for further analysis, and disposed of in a labeled waste fuel container. Pilots who fail to comply with this procedure are subject to governmental agency and/or civil prosecution.

7. Pilots must verify the correct Hobbs time before each flight, reporting discrepancies to the WFA Dispatcher before starting the aircraft, and recording the ending Hobbs time on the clipboard. If the tenth's digit is starting to roll to the next digit, the higher number must be recorded. If the Hobbs meter is inoperative, multiply tachometer time by 1.2 to determine billed flight time.

8. The pilot is responsible for returning the aircraft to its home base. If the pilot chooses to abandon aircraft due to weather, aircraft problems, or any other reason, then the pilot will be charged with recovery fees and expenses incurred by WFA. The WFA Dispatcher must be notified when an aircraft will not be returned at the scheduled time. Aircraft problems requiring service before continuing flight must be reported to the WFA Dispatcher. If the cost of repair is less than $200, the pilot is authorized to have an on-site mechanic fix the aircraft. If the repair cost exceeds $200, WFA must authorize the repairs in advance and will reimburse pre-authorized repair costs, provided the pilot provides WFA with an original receipt for repairs paid for by the pilot. WFA is not liable for failure of aircraft systems or equipment during operations away from KHDO. WFA will repair or have the aircraft repaired as soon as possible. WFA will reimburse fuel purchased away from KHDO provided the pilot presents an original receipt. Only AvGas and aircraft oil costs will be reimbursed. No other operating costs, purchases, or fees will be reimbursed, unless authorized by the Manager on Duty.

9. WFA "Training Aircraft" are reserved for dual and solo flight lessons, to include 2.5 hour pilot proficiency flight blocks. The course name and lesson number should appear on both the reservation and dispatch form when applicable. Training aircraft may only be scheduled for the length of the lesson as shown in the training syllabus, plus reasonable transit and refueling time, or 2.5 hour pilot proficiency block. Students who keep a training aircraft past its scheduled return time, will be invoiced for "waiting" time at the full retail hourly rate. "Training" aircraft may not be taken overnight. Minimum charges do not apply in situations where the pilot is unable to return the aircraft due to mechanical or weather problems.

10. WFA "Rental Aircraft" are subject to a 3 hour per day minimum charge, if the renter has the aircraft for more than 6 hours in a 12 hour period. Renters must have a credit card on file prior to making a reservation. Minimum charges do not apply in situations where the pilot is unable to return the aircraft due to mechanical or weather problems.

11. Instruction in any Wright Flyers aircraft by a flight instructor not employed by Wright Flyers Aviation, Inc. is strictly prohibited.

12. Night / overnight rentals must be approved by the Manager on Duty before making a reservation.

13. Non-emergency off-airport landings, or landings at unpublished airports in WFA aircraft are prohibited.

14. Flights conducted outside of the continental United States are prohibited.

15. Pilots are responsible for securing aircraft after each and every flight to include: ignition & master switches off; tie downs, wheel chocks, pitot tube cover & control wheel lock in place; windows closed and door secured. Don't risk your pilot certificate - FAA regulations prohibit removal of any item required for the safe operation of an aircraft. Examples include pitot tube covers, fuel drain cups, fuel dip sticks, tow bars and manuals.

16. Spin maneuvers are allowed only in WFA designated aircraft.

17. Smoking is prohibited in all WFA aircraft.

18. WFA is not responsible for items left unattended on our premises, or in our aircraft.

19. The pilot will be charged for the following miscellaneous costs:

  1. Excessive or unnecessary wear of the aircraft, or any of its parts or components, due to pilot neglect, or poor technique. Examples include flat spotted tires, collapsed nose gear and damaged wing tips
  2. Neglect of proper checklist procedures, such as leaving the master-switch on
  3. Lost keys for the aircraft and / or fuel pump
  4. Items missing from the aircraft, such as fuel drain cup, pitot covers, control wheel lock, manuals and aircraft documentation
  5. Rented items either not returned, or returned in defective condition

20. Pilots are responsible for knowing their flight schedules, and arriving on time for lessons and flights. Flights may be cancelled on-line or by phone without penalty if weather conditions fall below FAA or Wright Flyers' minimums. Otherwise, reservations must be cancelled on-line or by phone at least twelve (12) hours before the scheduled start time, in order to avoid a cancellation charge. The cancellation charge will be equal to the actual rental and instructor fees for the total hours reserved.

21. Payment is due when services are rendered. Customers electing to keep funds on account may request cash withdrawals at any time. Unused student loan balances will be returned to the lender or lender's agent within 30 business days from receipt of customer's written notification of program completion, termination or transfer.

22. Customers will be charged a $25.00 fee for returned checks and Credit Card denials.

23. WFA has the right to refuse service to anyone for any reason at the sole discretion of the Manager on Duty.

Under certain circumstances, these requirements may be waived by the Company's Chief Flight Instructor.

Insurance

WFA maintains $1,000,000 single limit/$100,000 per seat public liability coverage on its aircraft. In addition, $100,000 of third party bodily injury & property damage liability insurance is included in our hourly aircraft rental rates.

The WFA insurance policy includes the following deductibles:

If the pilot is deemed negligent, he or she will be held responsible for any deductible paid by WFA. The pilot may also be responsible for other damages or causes of action not covered by the above mentioned insurance policy. Our underwriter at all times maintains the right of subrogation to the aircraft operator in the event of an insured loss.
